Aggravated Battery May Cause Death Or Great Bodily Harm
Legal Definition
A person commits aggravated battery when they unlawfully touch or apply force to another in a rude, insolent, or angry manner and the battery is committed with a deadly weapon or in a manner likely to cause death or great bodily harm. The offense requires either the use of a deadly weapon or conduct that poses a substantial risk of serious physical injury. Unlike simple battery, aggravated battery involves circumstances that elevate the danger or harm to the victim.
Possible Punishment
Basic sentence of 3 years imprisonment; fine up to $5,000. A mandatory period of parole follows release. If the aggravated battery results in great bodily harm, the basic sentence increases to 6 years under the provision for third degree felonies resulting in death or great bodily harm. Sentence enhancements may apply for use of a firearm or habitual-offender status.
Local Context
This charge typically applies when the battery involves a deadly weapon (such as a knife or firearm) or when the manner of the attack creates a likelihood of death or great bodily harm, even if serious injury does not actually occur. The statute distinguishes aggravated battery from simple battery (a petty misdemeanor) based on the presence of a deadly weapon or the potential for serious harm. The classification remains a third degree felony regardless of whether great bodily harm actually results, though the sentence length may increase to 6 years if it does.
Violent-Crime Cases in Doña Ana County
Violent charges are where New Mexico's pretrial system shows its teeth. For serious felony cases (aggravated battery, armed robbery, homicide), the District Attorney frequently files a pretrial detention motion asking the Third Judicial District Court to hold the defendant with no possibility of release. That is why some people in our booking feed are released within a day while others charged under the same statute stay in custody until trial.
Many bookings in this category involve household members, which triggers additional consequences: no-contact release conditions, orders of protection, and, after a qualifying conviction, a federal firearm prohibition. Charges listed at booking are the arresting officer's charges; the DA decides what is actually filed, and amendments are common in violent-crime cases as evidence develops.
