1. About the Service

Las Cruces Mugshots is an independent news and public-records publication. We gather, report, and comment on arrests, jail bookings, criminal charges, and related matters of public record in Doña Ana County, New Mexico. The Site is editorial in nature and operates as a news and information service for the public.

2. Public Records, Journalism, and Content Rights

The booking information we publish, including names, ages, charges, booking numbers, and booking photographs ("mugshots"), is drawn from government records that are public record under New Mexico and federal law. Records created by government agencies are generally not subject to copyright and reside in the public domain.

We collect, publish, and report on this public-record information as an exercise of freedom of the press and freedom of speech protected by the First Amendment to the United States Constitution and the Constitution of the State of New Mexico. Reporting truthful information lawfully obtained from public records is a core journalistic function, and we assert our right to do so for news, historical, educational, and informational purposes.

Our reporting, original headlines, written summaries, page layouts, compilation, and presentation of this information are our editorial work product. Nothing in these Terms transfers any right in the underlying public records, which remain public record.

3. No Assertion of Guilt; Presumption of Innocence

An arrest or booking is not evidence of guilt. All persons referred to on the Site are presumed innocent unless and until proven guilty in a court of law. The presence of a booking record does not imply that the individual committed any crime. Charges may be amended, reduced, dismissed, or never formally filed.

4. Accuracy and No Warranty

The Site is provided on an "as is" and "as available" basis. Booking data originates with third-party government sources and may contain errors, omissions, or outdated information. We do not warrant that the Site or its content is accurate, complete, current, or error-free, and we make no warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. Information on the Site is not legal advice and should not be relied upon as such. Always verify information with official government sources.

5. Corrections and Removal Requests

While the information we publish is public record, we review correction and removal requests in good faith. If you believe a record is inaccurate, your charges were dismissed or dropped, or your record has been expunged or sealed, contact us through our Contact page. We evaluate each request individually and are not obligated to remove lawfully published public-record information except as required by applicable law.

We never charge a fee to remove or correct a record, and we never will. Any demand for payment in exchange for a removal or correction is not authorized by Las Cruces Mugshots, constitutes extortion, and is illegal. If anyone claiming to represent us, or appearing to represent us, asks you for a removal fee, do not pay. Report it to us immediately through our Contact page or our Facebook page so we can act on it.

6. Acceptable Use

You agree not to:

• Use the Site to harass, threaten, defame, or harm any person.
• Post comments that are unlawful, abusive, hateful, or knowingly false.
• Scrape, harvest, or systematically extract content from the Site except through means we expressly authorize.
• Interfere with or disrupt the Site, its security, or its infrastructure.
• Use the Site or its content to make decisions about employment, housing, credit, insurance, or other purposes regulated by the Fair Credit Reporting Act. The Site is not a consumer reporting agency and the content is not a consumer report.

7. User Comments

You are responsible for any comment or content you submit. By submitting content, you grant us a non-exclusive, royalty-free, worldwide license to display, reproduce, and distribute that content on the Site. We may, but are not required to, moderate, edit, or remove comments at our discretion, including content that violates these Terms.

8. Intellectual Property

The Site's original content, design, branding, and trademarks are owned by Las Cruces Mugshots or its licensors and are protected by applicable law. You may not copy, reproduce, or redistribute our original editorial content without permission, except as permitted by fair use. The underlying public records themselves remain public record.

9. Third-Party Links and Advertising

The Site contains advertising and may link to third-party websites. We are not responsible for the content, products, services, or privacy practices of third parties. Your interactions with advertisers and third-party sites are solely between you and them.

10. Limitation of Liability

To the fullest extent permitted by law, Las Cruces Mugshots and its operators will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss arising from your use of, or inability to use, the Site or its content, even if advised of the possibility of such damages.

11. Indemnification

You agree to indemnify and hold harmless Las Cruces Mugshots and its operators from any claims, damages, liabilities, and expenses arising out of your use of the Site, your content, or your violation of these Terms.

12. Governing Law

These Terms are governed by the laws of the State of New Mexico, without regard to its conflict-of-laws rules. Any dispute arising from these Terms or the Site will be subject to the exclusive jurisdiction of the state and federal courts located in New Mexico.

13. Changes to These Terms

We may update these Terms from time to time. When we do, we will revise the "Last updated" date above. Your continued use of the Site after changes take effect means you accept the updated Terms.
