§ 30-16-33 NMSAFourth Degree Felony Property

Fraudulent Transport Of Credit Card

Legal Definition

A person commits fraudulent transport of a credit card when they knowingly transport a credit card or credit card information outside New Mexico with the intent to use, sell, or transfer the card or information to persons other than the issuer or cardholder. The offense targets the interstate movement of stolen or fraudulently obtained credit card instruments or data for purposes of fraud or unauthorized distribution.

Possible Punishment

Basic sentence of 18 months imprisonment; fine up to $5,000. A mandatory period of parole follows release.

Local Context

This offense is part of New Mexico's comprehensive credit card fraud statute (§ 30-16-33), which criminalizes various forms of credit card misuse including fraudulent possession, receipt, and transport. The transport element requires proof of intent to defraud or unlawfully distribute the card or information across state lines.

Property-Crime Cases in Doña Ana County

Property charges in New Mexico scale with dollar value and circumstances. The same shoplifting conduct can be a petty misdemeanor or a felony depending on the value of what was taken, and burglary escalates sharply when the structure is a home or someone is inside. That is why our charge database lists several versions of larceny and burglary with different classifications.

Property cases also drive a large share of repeat bookings: failure to appear on an older larceny case frequently brings someone back into the detention center on a bench warrant alongside any new charge.
