Abuse Of A Child
Legal Definition
A person commits abuse of a child when, having custody or control of a child under the age of eighteen, they knowingly, intentionally, or negligently cause or permit the child to be placed in a situation that may endanger the child's life or health, or cause or permit the child to be tortured, cruelly confined, cruelly punished, or deprived of necessary food, clothing, or shelter. The offense includes acts or omissions that result in physical or mental injury to the child.
Possible Punishment
Basic sentence of 3 years imprisonment and a fine up to $5,000 for a third degree felony. If the abuse results in great bodily harm or the death of the child, it is a second degree felony with a basic sentence of 15 years imprisonment and a fine up to $12,500. A mandatory period of parole follows release.

The offense may be charged based on affirmative acts of harm or on negligent failure to protect the child from dangerous conditions.
