Criminal Trespass
Legal Definition
A person commits criminal trespass by knowingly entering or remaining on real property without permission of the owner or person entitled to possession. The offense includes entering property after being notified not to enter, or remaining after being told to leave. Trespass may occur on land, in buildings, or in other structures where the person has no lawful right to be present.
Possible Punishment
Up to 6 months in county jail and a fine up to $500. Criminal trespass is typically charged as a petty misdemeanor absent aggravating circumstances that would elevate the offense under related statutes.
Local Context
The statute distinguishes between different types of trespass based on the nature of the property and the defendant's intent. Aggravated circumstances—such as trespassing with intent to commit a felony, or trespassing on certain protected properties—may be charged under separate, more serious provisions within § 30-14-1 or related statutes, potentially elevating the offense to a misdemeanor or fourth degree felony.
Property-Crime Cases in Doña Ana County
Property charges in New Mexico scale with dollar value and circumstances. The same shoplifting conduct can be a petty misdemeanor or a felony depending on the value of what was taken, and burglary escalates sharply when the structure is a home or someone is inside. That is why our charge database lists several versions of larceny and burglary with different classifications.
Property cases also drive a large share of repeat bookings: failure to appear on an older larceny case frequently brings someone back into the detention center on a bench warrant alongside any new charge.
