Probation Violation
Legal Definition
A probation violation occurs when a person who has been placed on supervised probation by a court fails to comply with the conditions of that probation. Conditions may include reporting to a probation officer, abstaining from alcohol or drugs, completing community service, paying restitution, or refraining from further criminal conduct. The court may revoke probation and impose the original suspended sentence or modify the terms of probation.
Possible Punishment
A probation violation is not a separate criminal offense with its own penalty. Upon a finding of violation, the court may revoke probation and impose any sentence that could have been imposed for the original underlying offense. The court may also continue probation with modified conditions, extend the probation period, or impose a period of incarceration not exceeding the balance of the original suspended sentence. Procedurally, the defendant is entitled to a revocation hearing, though the standard of proof is preponderance of the evidence rather than beyond a reasonable doubt.
Local Context
Probation violations are civil proceedings ancillary to the original criminal conviction. The severity of consequences depends entirely on the classification and penalty range of the underlying offense for which probation was originally granted. Common violations include new criminal charges, positive drug tests, failure to report, and failure to pay court-ordered fees or restitution.
Holds, Warrants, and Procedural Bookings
