Resisting Or Obstructing
Legal Definition
A person commits resisting, evading, or obstructing an officer when they knowingly obstruct, resist, or oppose any officer of this state or any other duly authorized person serving or attempting to serve or execute any process or rule or order of any court, or any other legal writ or warrant. The statute also covers resisting or obstructing an officer in the discharge or attempted discharge of their official duties.
Possible Punishment
Up to 364 days in county jail and a fine up to $1,000. If the resistance involves battery upon a peace officer, the offense may be charged under § 30-22-24 or § 30-22-25 as a separate, more serious offense.

This offense does not require physical force; verbal obstruction or passive resistance that impedes an officer's lawful duties may suffice. The officer must be acting lawfully at the time. Battery on a peace officer is a distinct, more serious charge under § 30-22-24 (Misdemeanor) or § 30-22-25 (Fourth Degree Felony if causing injury).
