Reckless Driving
Legal Definition
A person commits reckless driving by operating a vehicle in willful or wanton disregard for the safety of persons or property. The offense requires more than ordinary negligence or inattention; it involves a conscious, deliberate indifference to the consequences of one's driving. Reckless driving may include excessive speeding, weaving through traffic, racing, or other conduct demonstrating a disregard for the rules of the road and the safety of others.
Possible Punishment
Up to 364 days in county jail and a fine up to $1,000. A conviction also results in six points assessed against the driver's license. The court may impose additional conditions such as driver improvement courses or community service.
Local Context
Reckless driving is distinct from careless driving (§ 66-8-114), which involves inattention or failure to exercise due care but does not require willful or wanton disregard. If reckless driving results in the death of another person, the offense may be prosecuted as vehicular homicide under § 66-8-101. Reckless driving is a common companion charge to DWI or may be offered as a plea reduction in some cases.
Criminal Traffic Cases in Doña Ana County
