Careless Driving
Legal Definition
A person commits careless driving when they operate a vehicle in a careless or imprudent manner, without due regard for the width, grade, curves, corners, traffic, and other attendant circumstances. The offense is less serious than reckless driving and typically involves inattention or a failure to exercise ordinary care rather than willful disregard for safety.
Possible Punishment
Up to 6 months in county jail and a fine up to $500. Courts may also impose traffic school, community service, or license suspension as conditions. Careless driving is often resolved through a penalty assessment without a court appearance.
Local Context
Careless driving is a common reduction from reckless driving charges and is frequently cited in minor accidents or traffic incidents where negligence is present but does not rise to the level of willful or wanton disregard. It is distinct from reckless driving under § 66-8-113, which requires a higher degree of culpability.
