Battery
Legal Definition
A person commits battery by intentionally touching or applying force to another person in a harmful or offensive manner, or by intentionally causing bodily harm to another. The offense does not require proof of injury, only that the contact was unlawful and either harmful or offensive. Battery is distinguished from assault, which involves attempted battery or placing another in reasonable apprehension of immediate battery.
Possible Punishment
Up to 6 months in county jail and a fine up to $500. Battery is classified as a petty misdemeanor under New Mexico law unless it involves circumstances that elevate it to aggravated battery, such as the infliction of great bodily harm or the use of a deadly weapon.
Local Context
Simple battery under § 30-3-4 is the base-level unlawful-contact offense. If the battery causes or is likely to cause great bodily harm, or involves a deadly weapon, it becomes aggravated battery under § 30-3-5, which is charged separately and carries felony-level penalties. Battery on a peace officer or school employee may also be charged under § 30-22-24 or § 30-22-25 as distinct offenses with enhanced penalties.
