§ 60-7B-1 NMSAPetty Misdemeanor Public Order

Minor In Possession Of Alcohol

Legal Definition

A person commits this offense if the person is under 21 years of age and knowingly possesses, consumes, or purchases alcoholic beverages, or misrepresents their age for the purpose of obtaining alcohol. The statute prohibits minors from having alcohol in their possession or control in any public place, vehicle, or establishment licensed to sell alcohol.

Possible Punishment

Up to 6 months in county jail and a fine up to $500. Courts typically impose community service, alcohol education programs, and driver's license suspension as conditions. A first offense often results in diversion or deferred sentencing rather than incarceration.

Local Context

This is a strict liability offense; the state need not prove intent to violate the law, only that the minor knowingly possessed or consumed alcohol. Exceptions exist for religious ceremonies, medical purposes, and consumption in a private residence with parental consent. Related offenses include furnishing alcohol to minors (§ 60-7B-1(B)) and using a false ID to obtain alcohol.

Public-Order Cases in Doña Ana County

Disorderly conduct, resisting or obstructing an officer, and giving false identification are classic add-on charges: they frequently ride along with something else in a booking rather than standing alone. Most are petty misdemeanors, the lowest tier of New Mexico offenses, with maximum exposure measured in months rather than years.

Because these charges often arise from chaotic street encounters, how a person behaves during the arrest matters enormously. Resisting is a separate crime even when the underlying stop goes nowhere, which is why knowing your rights, and asserting them calmly, is the practical advice every attorney gives.
