Fugitive From Justice
Legal Definition
A person is a fugitive from justice when they have been charged with or convicted of a crime in another jurisdiction and are found in New Mexico while fleeing from or avoiding prosecution or confinement. The Uniform Criminal Extradition Act authorizes the arrest and detention of fugitives to facilitate their return to the demanding state. This is not an independent substantive offense but a procedural status allowing extradition proceedings.
Possible Punishment
No independent penalty is imposed for fugitive status itself. The individual is held pending extradition to the jurisdiction where the underlying criminal charge or conviction exists. If extradition is waived or granted, the person is transferred to face the original charge or sentence. If extradition is denied or the demanding state does not pursue the matter, the hold is released.
Local Context
This code represents a detainer or hold, not a New Mexico criminal offense. The fugitive may contest extradition through habeas corpus proceedings. The underlying offense in the demanding jurisdiction determines any ultimate criminal liability. New Mexico law requires the demanding state to present proper documentation (governor's warrant) to complete extradition.
