Failure To Pay Fines
Legal Definition
A person commits this offense by willfully failing to pay fines, fees, or costs imposed by a court as part of a criminal sentence or judgment within the time ordered by the court. The failure must be willful — that is, the person had the ability to pay but refused or neglected to do so. Courts may issue bench warrants for arrest when a defendant defaults on payment obligations without demonstrating inability to pay or requesting a modification.
Possible Punishment
Penalties vary by the underlying offense and court order. A court may impose additional fines, extend payment deadlines, order community service in lieu of payment, or issue a bench warrant for arrest and hold the person in custody until payment arrangements are made or a hearing is conducted. Incarceration solely for inability to pay without a willfulness finding is prohibited under New Mexico law. Courts must inquire into ability to pay before imposing jail time for nonpayment.
