No Driver's License
Legal Definition
A person commits the offense of No Driver's License when they operate a motor vehicle on New Mexico roads without possessing a valid driver's license as required by law. This misdemeanor applies to individuals who have never obtained a license, whose license has expired, or who fail to carry proper licensing credentials while driving. The offense is distinct from driving on a suspended or revoked license, which carries separate penalties.
Possible Punishment
Driving without being licensed is a misdemeanor punishable under the Motor Vehicle Code's general penalty by up to 90 days imprisonment and/or a fine of up to $300.
Local Context
This charge typically arises during traffic stops when a driver cannot produce a valid New Mexico or out-of-state driver's license. First-time offenders who subsequently obtain a valid license may receive more lenient treatment. The offense does not apply to certain exempted categories such as non-resident visitors with valid licenses from their home jurisdiction or individuals operating vehicles on private property.
