Speeding
Legal Definition
A person commits speeding when they operate a motor vehicle at a speed greater than is reasonable and prudent under the conditions then existing, or in excess of a posted maximum speed limit. New Mexico law establishes prima facie speed limits (e.g., 75 mph on certain rural interstate highways, 55 mph on other highways, 30 mph in urban districts) and authorizes local authorities to set lower limits. Speeding is a noncriminal traffic violation subject to a penalty assessment rather than criminal prosecution.
Possible Punishment
Speeding is a noncriminal traffic violation. Penalties are assessed through a civil penalty schedule rather than criminal sentencing. The fine amount varies based on the degree over the posted limit and jurisdiction, typically ranging from approximately $20 to $100 or more for excessive speeds. No jail time is imposed for a simple speeding violation. Accumulation of points on a driving record may result in license suspension under separate administrative proceedings.
Local Context
Speeding becomes a criminal misdemeanor if it rises to the level of reckless driving (§ 66-8-113 NMSA) or careless driving (§ 66-8-114 NMSA). Excessive speeding (30+ mph over the limit in some jurisdictions) may trigger enhanced penalties or mandatory court appearances. This charge code refers to the basic noncriminal speeding violation.
Criminal Traffic Cases in Doña Ana County
Not every traffic offense is a ticket. Driving on a suspended or revoked license, reckless driving, and fleeing an officer are criminal charges that end in booking rather than a citation, and they appear constantly in our feed. Suspended-license charges in particular tend to snowball: unpaid fines lead to suspension, driving anyway leads to arrest, and missing the court date adds a bench warrant.
Criminal traffic cases are heard in Las Cruces Municipal Court for city violations and Doña Ana Magistrate Court for state charges. If alcohol or drugs are involved, the case moves into DWI territory with its own mandatory penalties.
