Aggravated Assault
Legal Definition
A person commits aggravated assault by unlawfully threatening or attempting to batter another person with a deadly weapon, or by threatening or attempting to batter another person while appearing to have the present ability to do so and the act causes the victim to reasonably believe they are in danger of receiving an immediate battery. The offense requires either the use of a deadly weapon or circumstances that create a reasonable apprehension of immediate serious harm.
Possible Punishment
Basic sentence of 18 months imprisonment; fine up to $5,000. A mandatory period of parole follows release. If committed with a firearm, a firearm enhancement may apply under § 30-7-7 NMSA, adding one year to the basic sentence.
Local Context
Aggravated assault is distinguished from simple assault (§ 30-3-1 NMSA, a misdemeanor) by the use of a deadly weapon or circumstances creating reasonable fear of serious bodily harm. It is also distinct from aggravated battery (§ 30-3-5 NMSA), which requires actual harmful or offensive contact rather than threat or attempt.
