Conspiracy To Commit 4th Degree Felony
Legal Definition
A person commits conspiracy when they agree with one or more persons to commit a felony and one of them performs an overt act in furtherance of the agreement. Conspiracy to commit a fourth degree felony is a specific charge when the target offense is a fourth degree felony under New Mexico law. The conspiracy itself is punishable even if the underlying felony is never completed.
Possible Punishment
Basic sentence of 18 months imprisonment; fine up to $5,000. A mandatory period of parole follows release. The sentence for conspiracy is the same as the sentence for the target offense; because the target here is a fourth degree felony, the conspiracy is also a fourth degree felony.
Local Context
Under § 30-28-3 NMSA, conspiracy is classified one degree lower than the target felony, but conspiracy to commit a fourth degree felony remains a fourth degree felony (it does not drop to misdemeanor). Common fourth degree felony targets include certain theft, fraud, forgery, drug possession, and property crimes. The overt act requirement means at least one conspirator must take a concrete step toward committing the planned offense.
